1. Acceptance of Terms

By accessing or using ("the Platform"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Platform.

2. Definitions

  • "Platform": The online medical consultation application and all associated services
  • "User": Any person accessing the Platform, including patients and healthcare providers
  • "Patient": Individual seeking medical consultation through the Platform
  • "Doctor": Registered medical practitioner providing consultation services
  • "Consultation": Medical advice, diagnosis, or treatment provided through the Platform
  • "We/Us/Our": [Company Name], the operator of the Platform
  • "Admin": Platform administrator who manages operational aspects including fee structure

3. Eligibility and Registration

3.1 User Eligibility

  • Users must be at least 18 years of age or have parental/guardian consent
  • Users must provide accurate and complete registration information
  • Users are responsible for maintaining the confidentiality of their account credentials

3.2 Doctor Registration

  • Doctors must possess valid registration with the Medical Council of India (MCI) or State Medical Council
  • Doctors must provide valid proof of medical qualification and registration
  • We reserve the right to verify credentials and reject or suspend any doctor profile
  • Doctors must provide their bank account details, which will be used by the platform to create a fund account on Razorpay for receiving consultation payments.

4. Nature of Service

4.1 General Description

The Platform facilitates connection between patients and doctors for online medical consultations. Doctors can choose to accept consultation requests at their discretion, similar to how ride-sharing platforms operate.

4.2 NOT FOR EMERGENCIES

THIS PLATFORM IS NOT INTENDED FOR MEDICAL EMERGENCIES.

In case of emergency, users must call local emergency services (dial 108 or 102 in India) or visit the nearest hospital immediately.

4.3 No Guarantee of Availability

We do not guarantee that a doctor will be available at any particular time. Doctors independently choose which consultation requests to accept.

4.4 Platform Role

We are a technology platform facilitating connections between patients and doctors. We do not:

  • Provide medical advice, diagnosis, or treatment
  • Practice medicine or provide healthcare services
  • Employ doctors or control their medical decisions
  • Guarantee the quality or outcome of consultations

5. Medical Disclaimer

5.1 Independent Professional Relationship

The relationship is between the patient and the consulting doctor. The Platform is not a party to this relationship and bears no responsibility for medical outcomes.

5.2 Limitations

  • Online consultations may not be suitable for all medical conditions
  • Doctors may not be able to diagnose conditions without physical examination
  • Users should seek in-person consultation when recommended by the doctor
  • Past consultations or medical records may not be accessible during emergency situations

5.3 User Responsibility

Patients are responsible for:

  • Providing accurate medical history and information
  • Following medical advice appropriately
  • Seeking second opinions when necessary
  • Understanding that online consultations have limitations

6. Payment Terms

6.1 Fee Structure

  • Consultation fees are set by the Platform Admin
  • The Platform retains a service/platform fee from each consultation
  • The remaining amount is transferred to the doctor's Razorpay fund account

6.2 Payment Processing

  • All payments are processed securely through Razorpay payment gateway
  • Users must pay the full consultation fee before connecting with a doctor
  • All fees are in Indian Rupees (INR)
  • We do not store doctor bank account details on our servers
  • Doctors receive payments directly into their Razorpay fund account

6.3 Doctor Payment Settlement

  • Doctor payments are processed through a Razorpay fund account created by the platform using the bank details provided by the doctor.
  • Doctors are responsible for providing accurate bank account information to enable payments.
  • Settlement timelines are subject to Razorpay's policies and procedures.
  • Any payment-related disputes must be raised with the platform, which will coordinate with Razorpay support as needed.

6.4 Refund Policy

  • If no doctor accepts the consultation within 24 hours, a full refund will be processed
  • If a doctor accepts but cancels before the consultation begins, a full refund will be issued
  • If consultation starts but technical issues prevent completion, refunds will be processed on a case-by-case basis
  • Refunds will be processed within 7-10 business days to the original payment method
  • No refunds after successful completion of consultation
  • Platform fees may be deducted from refunds in certain circumstances

6.5 Failed Transactions

We are not responsible for payment failures due to bank issues, insufficient funds, or technical problems on the payment gateway side.

7. Video Consultation Guidelines

7.1 Platform Usage

  • Video consultations are conducted through Jitsi video calling platform
  • Users must have stable internet connection and compatible device
  • Users must ensure privacy during consultation
  • Both parties must have camera and microphone access enabled

7.2 Recording Policy

  • Consultations are not automatically recorded by the platform.
  • If recording is enabled, all participants will be notified beforehand.
  • Any recordings, if taken, are stored securely and deleted after a set retention period.
  • Users are strictly prohibited from recording consultations without consent from all parties.

7.3 Technical Issues

  • We strive for reliable service but do not guarantee uninterrupted access
  • We are not liable for connection failures, audio/video quality issues, or third-party platform downtime
  • In case of technical failure during consultation, users should contact support for resolution and potential refund
  • Jitsi platform availability and performance is subject to their service terms

8. Privacy and Data Protection

8.1 Data Collection

We collect and process personal and medical information as described in our Privacy Policy. By using the Platform, you consent to such collection and processing in compliance with applicable data protection laws.

8.2 Medical Confidentiality

  • Doctors must maintain patient confidentiality per medical ethics and regulations
  • We implement appropriate security measures to protect health information
  • Medical records are stored securely with encryption
  • Access to medical data is restricted to authorized personnel only

8.3 Financial Data Security

  • We do NOT store doctor bank account details or sensitive financial information
  • All payment processing is handled securely by Razorpay
  • Doctor payment details are maintained directly with Razorpay's fund account system
  • Patient payment information is processed according to PCI DSS standards

9. User Conduct and Responsibilities

9.1 Prohibited Activities

Users must not:

  • Misuse the Platform for illegal or unauthorized purposes
  • Provide false or misleading information
  • Harass, abuse, or harm other users or doctors
  • Attempt to breach security or access unauthorized areas
  • Share account credentials with others
  • Use the Platform to promote or sell products/services

9.2 Doctor Responsibilities

  • Maintain valid medical registration and credentials
  • Provide professional and ethical medical care
  • Ensure that any consultation or query accepted is completed in a timely manner
  • Maintain accurate availability status on the Platform
  • Keep Razorpay fund account details updated for payment receipt
  • Comply with all applicable medical laws and regulations

10. Intellectual Property

All content, trademarks, logos, and intellectual property on the Platform are owned by us or licensed to us. Users may not reproduce, distribute, or create derivative works without written permission.

11. Limitation of Liability

11.1 Platform Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Medical advice, diagnosis, or treatment provided by doctors
  • Technical failures or service interruptions
  • Payment processing delays or failures
  • Unauthorized access to user data
  • Actions or omissions of doctors or other users

11.2 Third-Party Services

We are not responsible for the actions, services, or failures of third-party platforms including Razorpay (payment processing) and Jitsi (video calling).

12. Termination

We reserve the right to suspend or terminate user accounts at our discretion for violation of these Terms, illegal activities, or any other reason we deem appropriate. Users may terminate their accounts at any time by contacting support.

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Kanhangad, Kerala.

13.2 Dispute Procedure

Users agree to first attempt resolution through our internal grievance mechanism before pursuing legal action.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Users will be notified of significant changes, and continued use of the Platform constitutes acceptance of modified Terms.
